An informative program directed to the family law practitioner to provide guidance in representing clients with the possibility of bankruptcy issues in association with  the prospect of their spouse filing or having filed for relief under the bankruptcy code and to minimize  the chances of domestic counsel being an unwitting creditor in bankruptcy due to the unavoidable consequence of the client being a debtor in bankruptcy.   The program will assist domestic counsel in anticipating the client that has a bankruptcy in their future, whether as debtor or creditor. The program will explain the impact of the automatic stay on family law proceedings, provide guidance to counsel for purpose of  moving forward with the divorce proceedings notwithstanding the stay and educate counsel regarding  the different treatment of the issues under Chapter 7, Chapter 13 and Chapter 11 proceedings. The impact of a bankruptcy discharge under the various chapters will be addressed . The issue of preferential payments or transactions  in relation to the transactions between the spouses and family members, as well as regards  the payment of attorney’s fees, will be discussed. Additionally, concepts associated with the strategic planning or coordination of  a bankruptcy filing for one or more of the spouses for purposes of maximizing the protection of the family’s assets and minimizing the payments to creditors will be explored.  Finally, a limited overview of the  foreclosure process and the family law trustee sale of  jointly owned real estate will be provided.
