Is it for You or for Them? Helping Mediators Make Informed and Intentional Decisions

Special Magistrate Sara Malik, Circuit Court for Montgomery County, Maryland; and Jessica Markham, Esq., Markham Law Firm

Do you meet with mediation participants separately as part of your regular mediation practice? If so, why? When? And for how long?  The trend has been to move to caucusing earlier and longer, but should we? While caucusing may improve how the participant perceives you, the Mediator, it also likely decreases trust in the process and the participants’ ability to resolve the conflict.

This highly interactive, skill-building and self-reflective program offers the opportunity for you to identify ethical considerations and challenges you face with caucusing and to discuss the tools and techniques you need to keep mediation participants in the room together for as long as possible, supporting their conversation and empowering them to resolve the conflict on their own.
