This program will provide practical insight on retirement and pension issues that arise in almost every divorce case involving Federal government retirement systems (FERS, CSRS, TSP), Foreign Service Pension System, and military retirement benefits, and State-sponsored retirement benefits (e.g., teachers, state police, firefighters, etc.). The program will also feature a brief introduction to Maryland’s new elective share law and its implications on a client’s estate planning needs prior to and during a divorce.   Key topics to be discussed:

1.   Plan and participant information to request during discovery;

2.  Introduction and unique aspects of each plan, what benefits are divisible, and how to divide those parts; 

3.   Mandatory and optional provisions to include in an order to divide;

4.   What provisions will cause the plan administrator to reject an order of division;

5.   Available survivor options for each plan, including eligibility, cost and how to elect them; and

6.  Beneficiary designations while a divorce is pending (before and after the elective share law takes effect in October, 2020).
