Two changes to the Federal Rules of Evidence coming into effect this year will help litigators simplify the challenges of admitting electronically stored information (ESI) at trial.  The rules allow for a certification process for digital information produced by a computer system or process, analogous to the provision for certification of business records.  The new rules also allow the authentication of a file by using its hash value, a unique identifier frequently referred to as a “digital fingerprint,” obviating the need for further authentication by witness testimony.  Learn how these changes can lessen your costs in litigation; and hear about other recent case law that affects your litigation practice.
