Commercial Litigation Section
On April 4, from 5:30 to 7:30 p.m. in the Bar Association’s headquarters the section is also sponsoring a CLE presented by Frank McGuire, Director, Disputes & Investigations, Duff Phelps, LLC, entitled Calculating Commercial Damages. This seminar details appropriate step-by-step methodologies for calculating damages in typical commercial disputes, such that the analyses will withstand judicial scrutiny and/or scrutiny by opposing counsel and experts. The presentation will also address the standards governing expert witness testimony, how to determine an appropriate discount rate, the calculation of prejudgment interest, and tax treatment of damages awards. This program is tailored toward commercial litigators or ADR-focused attorneys who deal with economic damages on either an affirmative or rebuttal basis. We are also sponsoring a CLE at Law Day on May 5th entitled When Deals Go Bad Who Pays: Understanding How Courts View Indemnification, Hold Harmless, and Fee Shifting Provisions. The program will explain how courts apply various risk shifting provisions of commercial agreements. Understanding how courts apply these provisions allows transactional attorneys to draft better agreements and helps commercial litigators evaluate their cases. The speakers are Gerald W.
